Can You Refuse To Inherit A Timeshare?

Can you refuse to inherit a timeshare questionFor some folks, owning a timeshare sounds like a great idea, a ticket to fantastic vacations. But for others, it’s more of a headache. If you find out you’ve inherited a timeshare, it’s not just about getting a vacation spot—it comes with costs and responsibilities.

You might not realize it, but owning a timeshare means paying maintenance or membership fees, which can add up fast. Plus, if there’s any unpaid balance on the timeshare, guess what? You might end up stuck with the bill. So, what are your options if you find out you’ve inherited a timeshare you don’t want?

Well, first off, you need to understand the ins and outs of timeshare ownership. It’s not just about saying yes or no; there are legal and financial aspects to consider. Getting advice from experts in real estate and inheritance law can help you figure out what to do next. Once you know your rights and obligations, you can start exploring your choices. Maybe you can transfer ownership, or perhaps there’s a way to get out of the timeshare altogether. Either way, this article may help you make an informed decision that work for you.

Because most timeshare is considered property, if you own it in your sole name at your death, then it could be passed onto your family members or others through your will.  If you do not have a will when you pass, your timeshare may go to your heirs as outlined in your state’s laws on intestacy.

If the property goes to your loved ones through a will, then the property must go through the probate process. What this typically means is that a court where the property is located will need to approve the transfer and ensure that all applicable laws have been followed. You may want a free consult on your contract with a timeshare attorney to find out exactly if and how timeshares can be passed down

Refusing A Timeshare Inheritance

As with any property that has been left to you, you are not required to accept it. But in order to decline your inheritance, you must follow your state’s laws on filing a disclaimer of interest. Typically, this document will need to be signed, dated, and filed with the probate court. You should be aware that when you refuse a timeshare inheritance, you will not be able to use it. Additionally, the timeshare could very well then pass to the person next in line to receive the deceased person’s property.

It is important that you understand that you must act fast if you want to refuse your timeshare inheritance. Depending on your state’s laws, if you become aware that you have been left a timeshare, and you do not file a disclaimer of interest in a timely manner, then you might end up becoming the legal owner.

If a timeshare seems to have some value to you, it may make sense for you to accept your inheritance and then try to sell it on the open resale market. You should be aware that accepting a timeshare will cause you to become the legal owner and be held to all the obligations and responsibilities of timeshare ownership.

Still, the cost of owning a timeshare may be far less than what you get for it if you sell. Consulting your state’s laws on inheritance taxes is also recommended as accepting a timeshare may result in you owing money to the IRS. Similarly, accepting a time share and then selling it may subject you to tax liability on the proceeds of the sale.

Louise, we are delighted to have an opportunity to brag about Finn Law Group. Finn Law Group et all provided my wife and I a great deal of confidence we had contacted the right organization to help us work through our time-share-nightmare. Their frequent updates ensured us that the firm was working our case diligently and we appreciated their communication as thet continued to work for us. For anyone who reads this review please realize that resolving these issues with time-share companies is not a quick fix overnight. But, I want to assure you that you would be hard pressed to find a more qualified company to represent you. Our case was resolved to our satisfaction and as Finn Law group represented themselves. Their fee is a small price to pay for the peace of mind they provided us. I cannot recommend them strongly enough. Time share free and so thankful to the Finn Law Group.

Best wishes to all at Finn and thank you. Mike and Vickie

I found Finn Law Group in July 2019 when I couldn't find a way to get rid of my timeshare. It had been given as a gift and I realized a few years later that it was not something I should have agreed to take on. After calling the timeshare directly to have them buy back or take it back, they simply replied that they don't do such things. I searched online for timeshare attorneys and found Finn Law Group. Mr. Finn and his team put me at ease and said they would work with me to get rid of the timeshare but made sure to tell me that it would take time. With COVID hitting less than a year later, it set the timeline back considerably. Finally, I got the call from Louise in January 2026 saying that the timeshare had been taken back and I was free and clear. It was one of the best calls I’ve ever received in recent memory. After securing the group’s services in 2019, Louise stuck with me and kept me updated and protected. I cannot thank her and everybody at Finn Law Group enough for their help with this matter. I highly recommend Mr. Finn, Louise, and everyone at Finn Law Group for their services. It was a long and nerve-wracking journey, but they succeeded and I’m eternally grateful. THANK YOU!

We contacted Finn Law Group about getting out of our timeshare and were so happy with the advice they gave us. Instead of charging us, they told us exactly what steps to take with our timeshare company, and it worked! In the end, we were able to get released from our contract for a fraction of what we thought it would cost. We really appreciate their honesty and guidance and would definitely recommend them.
