What Happens to Your Timeshare When You Stop Paying

What Happens to Your Timeshare When You Stop Paying

What Timeshare Owners Should Know Before Missing a Payment

For many timeshare owners, the point where fees become unmanageable arrives gradually. What starts as a maintenance bill that feels unreasonably high eventually becomes a financial obligation that seems impossible to sustain. Before stopping payment, it is worth understanding what the contract actually triggers, what options exist at each stage, and why the window for a legally clean resolution tends to narrow over time.

This is not meant to alarm you. It is meant to give you an accurate picture of what timeshare default looks like so that you can make decisions based on information rather than assumption.

The Default Process Starts Faster Than Most Owners Expect

Timeshare developers treat maintenance fee revenue as core to their business model. Unlike a personal credit card with informal late periods, most timeshare contracts classify a missed payment as a formal delinquency within days of the due date. Internal collections activity typically begins within the first 30 days, and fees begin accumulating almost immediately.

This speed is not accidental. Developers have no financial incentive to absorb unpaid accounts quietly. The contract language almost universally reflects this, and many owners are surprised to discover how quickly their account status changes after a single missed payment.

What Happens as the Delinquency Continues

Collections Escalation

Once an account is delinquent, contact by phone, mail, and email typically increases in frequency. After 90 days, many developers transfer the account to a third-party collections firm. At that point, a separate entry may appear on your credit report in addition to the original delinquency. If the debt is resold to another agency, each subsequent collector can add its own entry, each with its own timeline.

The Lien Filing

As the delinquency continues, developers have the legal right to record a lien against the timeshare interest. This is a public record. It signals escalation from collections activity into formal legal posture. For owners with real estate holdings, a recorded lien can complicate other transactions depending on how the timeshare is structured.

Credit Score Impact

Credit damage from timeshare nonpayment tends to compound rather than stabilize. Each collections action, each new entry, and each subsequent agency adds negative items with independent seven-year reporting windows. Owners who assume the impact will be temporary or limited often find the opposite, particularly when multiple entries accumulate over a long delinquency period.

Why Waiting Is Rarely a Strategy

A common belief among owners who stop paying is that the situation will eventually resolve itself on its own terms. In practice, the opposite tends to happen. Timeshare developers do not write off delinquent accounts and move on. They have contractual standing and financial motivation to pursue unpaid balances, and accounts that go quiet for months often resurface with a new collections agency, a higher balance, and a narrower set of options than existed at the start.

Owners who address the situation proactively, before accounts are transferred, before liens are recorded, before additional entries appear on credit reports, typically have more paths available to them. An attorney can review the original purchase contract, evaluate the circumstances of the sale, and determine whether there are legal grounds to pursue cancellation of the underlying obligation. That legal review eliminates the debt entirely rather than simply managing its consequences.

Exit companies are not the same as attorneys. They are not licensed to practice law, cannot represent you in negotiations with developers, and cannot pursue legal claims on your behalf. Understanding the difference matters when the outcome you need is a legally enforceable cancellation, not a third-party promise.

What an Attorney Can Actually Do

Stopping payment without a legal framework behind it is a reaction, not a resolution. Owners who are struggling with maintenance fee obligations have more options available, but those options are more accessible before defaulting rather than after.

A review of the original purchase contract and the circumstances of the sale is a useful starting point. Many timeshare owners were subjected to sales tactics or verbal representations that carry legal significance. An attorney can evaluate whether those circumstances support a path to cancellation. A legitimate legal exit eliminates the underlying contractual obligation entirely, which stops fee accumulation and addresses the basis for any collections activity, producing a cleaner resolution rather than years of escalating credit damage.

What the Legal Review Covers

  • The purchase contract and all signed addenda
  • The sales presentation and any verbal representations made at the time
  • Disclosure compliance under applicable state law
  • Rescission period and whether it was properly presented
  • Any subsequent fee increases or changes to the ownership terms

The attorneys at Finn Law Group have represented timeshare owners in these matters for over thirty years. Managing attorney J. Andrew Meyer leads the litigation division, which has handled individual, multi-plaintiff, and class action timeshare cases in state and federal courts. Finn Law Group has been featured in the New York Times, AARP, Kiplinger’s, and on HBO’s Last Week Tonight for its work representing timeshare owners against industry practices.

Timeshare Cancellation vs. Foreclosure: Understanding the Distinction

These are not the same outcome. Cancellation, when achieved through legal means, terminates the contractual relationship with the developer. It eliminates the ongoing obligation, the maintenance fee liability, and the interest in the property. The resolution is documented and enforceable.

Foreclosure is the developer’s enforcement mechanism when a default goes unresolved. It is a legal proceeding that takes the timeshare back, but it does not necessarily end the financial obligation in the same way. Depending on the contract and the state, a deficiency balance may remain, and the credit consequences are significant.

The goal of working with an attorney is to pursue cancellation rather than to arrive at foreclosure. The two paths begin from the same place, a fee obligation that has become unworkable, but they lead to very different outcomes. Legal review is most useful when it happens before the situation has escalated rather than after.

Frequently Asked Questions

What happens if I just stop paying my timeshare maintenance fees? The account will be flagged as delinquent within days. Collections activity begins quickly, fees accumulate on the outstanding balance, and the situation tends to escalate toward lien filings and credit reporting entries. The options available narrow as the delinquency ages.

Can a timeshare attorney help if I am already behind on payments? Yes. An attorney can review your contract and the circumstances of your purchase to evaluate whether legal grounds for cancellation exist. Earlier intervention typically produces a cleaner outcome, but legal review remains useful even after a delinquency has started.

Is timeshare cancellation different from just walking away? Walking away without a legal strategy means the obligation continues. Cancellation through an attorney legally terminates the contract, which stops the fee liability and addresses the basis for collections. It is a resolution, not just an exit.

How do I know if I have legal grounds to cancel my timeshare? That depends on your specific contract, the sales circumstances, and applicable state law. A legal review by an attorney familiar with timeshare contracts is the only way to evaluate your situation accurately. Finn Law Group offers a free initial consultation for this purpose.

I found Finn Law Group in July 2019 when I couldn't find a way to get rid of my timeshare. It had been given as a gift and I realized a few years later that it was not something I should have agreed to take on. After calling the timeshare directly to have them buy back or take it back, they simply replied that they don't do such things. I searched online for timeshare attorneys and found Finn Law Group. Mr. Finn and his team put me at ease and said they would work with me to get rid of the timeshare but made sure to tell me that it would take time. With COVID hitting less than a year later, it set the timeline back considerably. Finally, I got the call from Louise in January 2026 saying that the timeshare had been taken back and I was free and clear. It was one of the best calls I’ve ever received in recent memory. After securing the group’s services in 2019, Louise stuck with me and kept me updated and protected. I cannot thank her and everybody at Finn Law Group enough for their help with this matter. I highly recommend Mr. Finn, Louise, and everyone at Finn Law Group for their services. It was a long and nerve-wracking journey, but they succeeded and I’m eternally grateful. THANK YOU!
