Timeshare Cancellation for Military Families

Timeshare Cancellation for Military Families

Military service often requires families to adapt to changing circumstances. Permanent Change of Station (PCS) orders, deployments, overseas assignments, and unexpected relocations can make long-term vacation planning difficult, even for families who originally believed a timeshare would fit their lifestyle.

What may have seemed like a convenient vacation option at the time of purchase can become an ongoing financial obligation years later, particularly when annual timeshare maintenance fees continue regardless of whether the property is ever used.

If your family’s military service has changed the way you are able to use your timeshare, understanding your legal options begins with reviewing your ownership and the circumstances surrounding your purchase.

Why Military Families Face Unique Challenges

Most timeshare ownership is built around predictability. Owners purchase vacation time with the expectation that they will be able to easily travel to various destinations or participate in an exchange program for years to come. Military life rarely follows a predictable schedule.

Relocations, deployments, training assignments, and changing family responsibilities can make vacation planning difficult. Even when travel is possible, the destination or timing offered through the timeshare may no longer meet the family’s needs.

While these life changes do not automatically cancel a timeshare agreement, they can often lead military families to reevaluate whether continued ownership still makes financial sense.

Understanding the Servicemembers Civil Relief Act (SCRA)

Many military families have heard of the Servicemembers Civil Relief Act (SCRA), a federal law that provides important legal protections for qualifying active-duty service members. The SCRA addresses a variety of legal and financial matters, including certain leases, financial obligations, and court proceedings. Depending on the specific facts, portions of the law may also become relevant when evaluating a timeshare ownership.

However, it is important to understand that the SCRA does not automatically cancel every timeshare contract. Whether military-specific protections apply depends on several factors, including when the contract was signed, the service member’s military status, the nature of any qualifying orders, and the specific circumstances surrounding the ownership. Because these situations are highly fact-specific, a legal review is often necessary before determining whether any protections may apply.

When Military Service Changes the Situation

Military families contact Finn Law Group for many different reasons. Some purchased a timeshare before receiving PCS orders that made regular use impractical. Others experienced multiple relocations that prevented them from using their ownership for years at a time.

Some families purchased during periods of transition, only to discover later that the ownership no longer fit their financial priorities or travel schedule. Others simply find that continuing to pay maintenance fees for a property they rarely use is no longer a practical financial decision. Every situation is different, and the appropriate legal analysis depends on the specific facts surrounding both the purchase and the family’s military service.

Documents That May Be Important

If you are considering having your ownership reviewed, gathering your documentation can make the process more productive.

Helpful documents often include:

  • Your purchase agreement and ownership documents
  • Financing documents, if applicable
  • PCS or deployment orders
  • Correspondence with the resort
  • Information about the sales presentation
  • Records of maintenance fees and special assessments

These materials help an attorney understand both your contractual obligations and the circumstances unique to your situation.

Why Legal Review Matters

Military families often assume that because they serve their country, their military status automatically provides a legal right to cancel a timeshare. Unfortunately, that is not always the case.

Likewise, some owners incorrectly assume they have no legal options at all. The reality is that every ownership should be evaluated individually. Military service may be one important factor, but it is only one part of the overall legal analysis.

An experienced timeshare attorney can review the purchase documents, discuss the circumstances surrounding the sale, evaluate whether military-specific protections may be relevant, and explain the legal options that may be available based on your individual circumstances.

Frequently Asked Questions

Does military service automatically allow me to cancel my timeshare?

No. Military service alone does not automatically terminate a timeshare agreement. However, depending on your circumstances, military-specific legal protections or other legal considerations may be relevant.

Does the Servicemembers Civil Relief Act apply to every timeshare?

Not necessarily. Whether the SCRA applies depends on the specific facts of your ownership, your military status, and the circumstances surrounding your purchase and service.

Can a PCS move affect my legal options?

A PCS relocation may be one factor considered during a legal review, particularly when evaluating the timing of the purchase and the circumstances that followed. Every situation is different.

Can my spouse communicate with the resort while I am deployed?

In many situations, yes. Your spouse may be able to gather documentation and communicate with the resort, although certain legal matters may require additional authority depending on the circumstances.

What information should I have available for an attorney?

Your purchase documents, military orders, financing information, correspondence with the resort, and any information relating to the sales presentation can all help an attorney evaluate your situation.

Final Thoughts

Military families face unique challenges that can significantly affect the value and practicality of timeshare ownership. While military service does not automatically provide a right to cancel a timeshare, it may be an important part of understanding your legal options.

If your family’s circumstances have changed and you would like to better understand your vacation ownership, an experienced timeshare attorney can review your documents and discuss the legal options that may be available based on your specific situation.

I found Finn Law Group in July 2019 when I couldn't find a way to get rid of my timeshare. It had been given as a gift and I realized a few years later that it was not something I should have agreed to take on. After calling the timeshare directly to have them buy back or take it back, they simply replied that they don't do such things. I searched online for timeshare attorneys and found Finn Law Group. Mr. Finn and his team put me at ease and said they would work with me to get rid of the timeshare but made sure to tell me that it would take time. With COVID hitting less than a year later, it set the timeline back considerably. Finally, I got the call from Louise in January 2026 saying that the timeshare had been taken back and I was free and clear. It was one of the best calls I’ve ever received in recent memory. After securing the group’s services in 2019, Louise stuck with me and kept me updated and protected. I cannot thank her and everybody at Finn Law Group enough for their help with this matter. I highly recommend Mr. Finn, Louise, and everyone at Finn Law Group for their services. It was a long and nerve-wracking journey, but they succeeded and I’m eternally grateful. THANK YOU!
