How to File an Attorney General Complaint for Timeshares

How to File an Attorney General Complaint for Timeshares

When a timeshare dispute becomes frustrating, many owners are not sure where to turn. They may have contacted the resort, spoken with a salesperson, called a management company, or tried to resolve the potential legal matter directly with the company without success. At that point, filing a complaint with the Attorney General’s office may be one option to consider.

An Attorney General complaint is not the same as retaining an attorney or filing a lawsuit. It also doesn’t guarantee that your timeshare will be canceled. However, it can create a formal record of your concerns and may help consumer protection authorities identify patterns involving timeshare sales, resale companies, exit companies, or debt collection practices.

What an Attorney General Complaint Can Do

State Attorneys General often maintain consumer protection divisions that receive complaints involving businesses, deceptive practices, scams, and unfair treatment. The National Association of Attorneys General explains that consumers should contact their own state consumer protection office directly when seeking assistance with a complaint.

For timeshare owners, a complaint may involve issues such as resale scams, misleading sales presentations, unexpected fees, aggressive collection activity, or problems with a timeshare exit company. The Florida Attorney General specifically warns that timeshare scams may occur both during the original purchase and when an owner later tries to resell the timeshare.

Start by Gathering Your Documents

Before filing a complaint, take time to organize your records. Helpful documents may include the purchase agreement, financing documents, maintenance fee statements, sales materials, emails, text messages, payment receipts, resale or exit company contracts, collection letters, and notes from phone calls.

The stronger your documentation, the easier it is to explain what happened. Try to create a simple timeline. Include the date of the sales presentation, when the contract was signed, what was promised, what payments were made, when problems began, and what steps you took to resolve the issue.

Be Specific About the Timeshare Problem

A strong Attorney General complaint should be clear, factual, and well organized. Rather than simply stating that a company “misled” you, explain exactly what was said, who made the statement, when it occurred, and why it influenced your decision to purchase, finance, or retain the timeshare. If your complaint involves a resale company or timeshare exit company, identify the services that were promised, the amount you paid, what was actually delivered, and any efforts you made to resolve the matter.

Details are important because consumer protection agencies receive thousands of complaints every year and must determine which matters warrant further review. Opening an investigation often requires more than a general allegation. Agencies typically look for documented facts, consistent patterns of conduct, and evidence that may indicate broader consumer harm. The more specific and well-supported your complaint is, the more useful it may be to regulators evaluating whether additional action is appropriate.

Avoid exaggeration or speculation. A complaint built on accurate facts, supporting documents, and a clear timeline will generally carry far more weight than one driven primarily by emotion or conclusions.

File the Complaint With the Right Agency

Most consumers begin with the Attorney General in their own state or the state where the company operates. NAAG provides a directory for finding state consumer protection offices.

Some timeshare issues may also be reported to other agencies. The FTC provides consumer guidance on timeshares, vacation clubs, and related scams. The FTC has also warned that timeshare owners may be targeted by scammers claiming to have interested buyers, then asking for upfront fees. If the issue involves financing, credit reporting, or debt collection, the Consumer Financial Protection Bureau may also be relevant because it accepts consumer complaints and forwards them to companies for response.

What to Include in the Timeshare Complaint

Your complaint should include your contact information, the company’s name, the dates involved, the amount of money paid, a short description of what happened, and the resolution you are requesting.

For example, you may be asking for a refund, cancellation of a disputed service agreement, investigation of a scam, correction of account information, or review of collection activity. Keep copies of everything you submit. If the complaint form allows attachments, include the most important documents, not every paper you have.

What Happens After You File

After a complaint is submitted, the Attorney General’s office may forward it to the business for a response, use it for consumer protection tracking, or review it for possible enforcement interest. Some complaints result in direct communication from the company. Others may not produce an individual resolution.

That does not mean the complaint was useless. Consumer complaints help agencies identify repeat conduct and broader patterns affecting the public.

When Legal Review May Still Be Important

Filing an Attorney General complaint can be an important step, but it is not a substitute for legal advice. If you are facing collection activity, foreclosure concerns, significant financial loss, an active contract dispute, or uncertainty about your timeshare obligations, speaking with an experienced timeshare attorney may help you better understand your rights and the options available to you.

An experienced timeshare attorney can review your contract, evaluate the facts surrounding your purchase or dispute, assess any supporting documentation, and explain whether additional legal or practical steps may be appropriate based on your individual circumstances. Even if you decide to file an Attorney General complaint, a legal review can help ensure you have a clearer understanding of your position before moving forward.

Final Thoughts

Remember, a well-prepared complaint can help create an official record, provide valuable information to consumer protection agencies, and contribute to broader efforts to identify patterns of misconduct within the timeshare industry.

At the same time, an Attorney General complaint is only one part of the process. If your situation involves a disputed contract, collection activity, foreclosure concerns, or significant financial loss, speaking with an experienced timeshare attorney may help you better understand your rights and evaluate the options available based on your specific circumstances. The key is preparation. Whether you choose to file a complaint, seek legal guidance, or both, taking informed and deliberate action is often the best way to protect your interests moving forward.

I found Finn Law Group in July 2019 when I couldn't find a way to get rid of my timeshare. It had been given as a gift and I realized a few years later that it was not something I should have agreed to take on. After calling the timeshare directly to have them buy back or take it back, they simply replied that they don't do such things. I searched online for timeshare attorneys and found Finn Law Group. Mr. Finn and his team put me at ease and said they would work with me to get rid of the timeshare but made sure to tell me that it would take time. With COVID hitting less than a year later, it set the timeline back considerably. Finally, I got the call from Louise in January 2026 saying that the timeshare had been taken back and I was free and clear. It was one of the best calls I’ve ever received in recent memory. After securing the group’s services in 2019, Louise stuck with me and kept me updated and protected. I cannot thank her and everybody at Finn Law Group enough for their help with this matter. I highly recommend Mr. Finn, Louise, and everyone at Finn Law Group for their services. It was a long and nerve-wracking journey, but they succeeded and I’m eternally grateful. THANK YOU!
Response from the owner:Thank you for your thoughtful review. It’s great to hear that Finn Law Group delivered the level of service you expected. Our team takes pride in providing our clients with both clarity and strong legal advocacy in timeshare property cancellations.
