Today, it has inspired real-world legislation in the form of the ‘Seinfeld Bill’ in New Jersey, which aims to provide greater consumer protection against intrusive telemarketing calls.
The ‘Seinfeld Bill,’ which was signed into law by Governor Phil Murphy on May 16, 2023 in New Jersey, is a recent development in the field of consumer protection. The bill aims to prevent deceptive or fraudulent practices by businesses during telephone transactions, an important aspect of maintaining a fair marketplace.
Instituting Greater Transparency and Accountability in Telemarketing
The Seinfeld Bill enforces strict regulations on telemarketing procedures. Telemarketers must disclose their identity by stating their name and the person or business they represent, and also state the purpose of the call within the first 30 seconds of their call.
Furthermore, the law mandates that telemarketers display their mailing address on any website they own and operate. They are also required to provide the address of any business they represent during their calls. This rule ensures a greater level of transparency and accountability from these telemarketing companies.

Senator Jon Bramnick, voiced his support for the new law, stating, “When you answer a telemarketer’s call, you should know right up front who they are and who they work for. If they’re on the up and up, telemarketing firms should have no issue with this bill.”

The legislation bans unsolicited telemarketing calls between 9 p.m. and 8 a.m., local time, at the customer’s location. Assemblyman Moriarty, a prominent advocate for senior rights, also commented on the new law. He stated that “There’s an overwhelming number of scams targeting seniors by phone. This new law will clearly alert seniors that a telemarketer is seeking to sell them something, and the law will provide them with a level of protection. It’s important to do what we can to protect our seniors from falling victim to scams. This may also help cut down on the overwhelming number of calls seniors receive at home.”

Specifically, if a customer initiates contact with a telemarketer either through a phone call or a website, and explicitly asks for a follow-up sales call or any other form of contact, these rules are not applicable.
